Bakebutik ("we," "us," or "our") is an online marketplace platform that provides independent home bakers and cottage food producers ("Sellers") with tools to create storefronts, list products, and receive orders from customers ("Buyers"). Bakebutik is operated as a technology platform only.
Bakebutik is not a food manufacturer, food service provider, restaurant, or delivery service. We do not prepare, handle, store, package, inspect, vet, or guarantee the safety or quality of any food items sold through our platform. All transactions are directly between the Seller and the Buyer. Bakebutik acts solely as a technology intermediary.
We do not verify that Sellers hold valid food handler permits, cottage food licenses, or any other regulatory approvals, though we require Sellers to certify that they do. Bakebutik shall not be held liable for any illness, injury, loss, or damage arising from food purchased through the platform.
By registering as a Seller, you certify that you:
All items sold on Bakebutik are prepared in private home kitchens that are not inspected or regulated to the same standards as commercial food establishments. Cross-contamination with common allergens, including but not limited to tree nuts, peanuts, gluten, dairy, eggs, soy, fish, and shellfish, is possible in any home kitchen environment.
If you have a severe food allergy or immune condition, do not purchase food through this platform without first contacting the Seller directly. Bakebutik makes no representations regarding the allergen safety of any listed item.
Bakebutik processes payments through Stripe, Inc. ("Stripe"). By using Bakebutik, you agree to Stripe's Terms of Service.
The Bakebutik platform is provided "as is" and "as available" without warranty of any kind, express or implied. We do not warrant that the service will be uninterrupted, error-free, or free of viruses. All products listed by Sellers are sold without any warranty from Bakebutik.
Sellers agree to defend, indemnify, and hold harmless Bakebutik and its officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) their food products; (b) their failure to comply with applicable laws or regulations; (c) any claims by Buyers regarding product quality, safety, or mislabeling; or (d) any violation of these Terms.
To the maximum extent permitted by law, Bakebutik shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, goodwill, or personal injury, arising from your use of the platform or consumption of any products purchased through it. Our total liability to you for any claim shall not exceed the greater of $100 or the platform fees paid by you in the three months preceding the claim.
Any dispute, claim, or controversy arising out of or relating to these Terms or your use of Bakebutik shall be resolved by binding arbitration under the rules of the American Arbitration Association (AAA), rather than in court, except that either party may seek injunctive or other equitable relief in court for claims involving intellectual property infringement. You waive any right to participate in a class action lawsuit or class-wide arbitration.
Bakebutik reserves the right to suspend or terminate any account at any time for any reason, including but not limited to: failure to provide proof of required permits, repeated complaints from Buyers, fraudulent activity, or violation of these Terms. Sellers will be notified via email upon termination.
We may update these Terms from time to time. We will notify registered Sellers via email at least 14 days before material changes take effect. Continued use of the platform after the effective date constitutes acceptance of the updated Terms.
These Terms are governed by the laws of the State of California, without regard to its conflict of laws principles.
